Kenneth Copeland Ministries Responds to Senator Grassley

On November 6, 2007, Senator Charles Grassley of Iowa announced an investigation of Kenneth Copeland, along with Benny Hinn, Paula White, Eddie Long, Joyce Meyer and Creflo Dollar by the United States Senate Committee on Finance. In a letter to each ministry, Grassley asked for the ministries to submit financial information to the committee to determine if any of the evangeslist made any personal profit from financial donations, and requested that the ministry make the information available by December 6, 2007.

According to IRS audits, none of the evangelists have used donor monies for personal advantage or illegal gain.

Senator Grassley's office recently issued a statement which said the ministries response has fallen "far short," and that while lines of communications are open, "additional steps in the congressional review" also would be considered. However, at this point, Sen. Grassley has not identified any violations of IRS non-compliance.

Copeland issued this release in response to Senator Grassley's statement:

Eagle Mountain International Church/Kenneth Copeland Ministries (the "Church") has reviewed Senator Grassley's July 7, 2008, "Memorandum to Reporters and Editors" on the status of the responses and level of cooperation received from the six church ministries who are the subject of the Senator's investigation that began in November 2007.

The Church's position continues to be that it has responded to the request of Senator Grassley in good faith and to the greatest extent possible without compromising the privacy, confidentiality, and freedom of association rights and protections afforded to the Church by the United States Constitution and the Internal Revenue Code (the "Code").

As stated in the Church's letters of December 6, 2007, and March 31, 2008, to Senators Grassley and Baucus, and in discussions with Committee staff members, the Church continues to believe that the most timely and efficient way for the Committee to obtain the requested confidential information -- without compromising the universally recognized fundamental constitutional and statutorily based rights of this Church and all religious institutions -- is for the IRS to request and obtain the information through a "church tax inquiry" under section 7611 of the Code. At the completion of the 90-day inquiry period provided by section 7611 of the Code, the IRS would have in its possession and available for disclosure to Senator Grassley all of the confidential information, including financial data, Senator Grassley is seeking from the Church.

Through this well-established statutory process, Senator Grassley and his staff could then obtain all of the information they seek through a request made under section 6103 of the Code, which would provide the Church with the confidentiality protections to which it is entitled. Had the Senator pursued this course suggested by the Church back in December, he would have the information he is seeking available to him at this time. The Senator's suggestion that the Church or its attorneys are being uncooperative or seeking to prolong the process is simply untrue.

Indeed, in an effort to expedite the process, in April the Church took the unprecedented step of pledging its cooperation to the IRS should the IRS undertake a church tax inquiry of the Church. Church and KCM CEO John Copeland said in a statement following his delivery of the letter to IRS offices in Dallas: "We told the IRS that we welcome them to come and make inquiry of us and we will provide answers to the IRS regarding questions that Senator Grassley has. The Church desires to protect its and all other churches' First Amendment rights, and by this action, we believe we are doing just that."

The Church respects the oversight role of the Senate Finance Committee and specifically the many efforts of Senator Grassley to provide oversight of tax-exempt organizations. Indeed, the Church has voluntarily adopted and adheres to policies and procedures that the Senator has publicly suggested over the years are appropriate governance practices for tax-exempt organizations.

However, the Church respectfully disagrees with Senator Grassley's position that churches are no different from any other tax-exempt organization. Any government inquiry into the affairs of a church raises serious constitutional issues that must be carefully balanced against the government's need to evaluate the effectiveness of the laws of the land.

To ensure its constitutional rights are not unnecessarily infringed upon, the Church firmly believes that it must be given the protections from disclosure afforded by the federal tax laws and the benefit of the processes and procedures that apply to inquires of churches made by the IRS. Without such confidentiality and due process of law, the potential exists for the information to be used in an effort to damage or attempt to embarrass the Church, its pastors, and its members. Any such use of the information provided interferes with, and ultimately threatens, the religious liberties of this Church, the thousands of other Pentecostal and Charismatic Churches who preach the "Word of Faith" message, and all other churches -- irrespective of their particular doctrine or faith.

Thank you KCM for standing up for U.S. ministry and our constitutional protection. The citizens which carry the title Senator are forgetting their responsibility to our constitution. They (Senators involved)should be censored by their constituants for ignoring due process and creating false sentiment in the American public.

I agree with you andbren. Copeland is doing the right thing here for sure. The implications for the future if the wrong decision is made are something to be feared. The government is pushing its way into our lives from every angle. Senator Grassley is certainly trying to help speed along the process.

I have loved and trusted KCM all my life. I know in my heart that the Copelands are doing as God instructs them. Jesus said we would be persecuted and what Sen. Grassley is persecution. It only re-enforces my belief that these ministries are doing the work of the LORD.

submit to all governing authorities, love your brothers in Christ, fear God, honor, yield to authority in this world.
It is proper behavior, don't forget our obedience is to the Lord, and your reward comes from Him. There should be no gray areas

Though I hold true to the fact we have seperation of church and state. I feel that the Copeland's has taken the widow's mite and has lived in excess for years. In the gospel of greed this group of believers are in, high society while good people give their last dollars to support them and they use it to by millions of dollars worth of houses and properties which has nothing to do with spreading the Gospel of Christ. All that matters is the LOST......nothing else. I say this with the Love of Jesus Christ Rev. Copeland get your priorities right.

I agree w/the above statements about the protection of our churches. I believe Sen. Grassley must revel the person who instigated him to doing this illegal act. That person must be exposed and what his motive is and why Grassley went along w/this act. We further believe that Senators should reveal their interest in our Constitution by revealing their 501-3(c)giving and whomever they support.QK

i am really shocked that senator grassley might think that the salary paid to these evanglists is the only income they have. i would not be suprised however, to find out that they do not recieve a "salary" at all from the churches they pastor. (i believe the yr. was '05/06 that Joel Osteen stopped accepting his salary from Lakewood Church-and he was not included in the investigation-hummm? and Rick Warren, well, he's a reverse tither) WOW!!! do you relly think that is all the money they earn?!?!?! after all, they are all authors and have teaching materials available for sale. certainly it is perfectly legal to request the information, but how about now taking as much time to inform the public of the results?

Then do what is right and he will commend you. For he is God's servant to do you good. But if you do wrong, be afraid, for he does not bear the sword for nothing. He is God's servant, an agent of wrath to bring punishment on the wrongdoer. Therefore, it is necessary to submit to the authorities, not only because of possible punishment but also because of conscience. This is also why you pay taxes, for the authorities are God's servants, who give their full time to governing. Give everyone what you owe him:(Rom. 13:3-7)
Anyone who does wrong will be repaid for his wrong, and there is no favoritism.(Col.3:23-25)

I am suspicious that this was friendly fire. A similar thing happened when George Bush senior was running for pres. He seemed to be one of those untrustworthy New-World-Order types and his camp came after religious people to fight off Pat Robertson's pres bid saying "you can't legislate religion" trying to discourage us and ruin Pat's base of support. Then suprizingly not resistance came from them when his son George W ran for office because he was billed as one of us born again folks and would for sure get our backing. But this year with Born-Again Huckabee in the mix they needed to suppress evangelicals again so that McCain who is not Born Again would have a fighting chance at the polls. Copeland Ministries and ORU in Tulsa both had many talk shows about politics durring the battle for Supreme Court judges but have been suprizing quiet durring this pres election. I think we all know why...it was a premeditated set up come down from the Conservative-Secularists in the halls of power
